FedEx driver claims Cigna/LINA owe long-term disability benefits

Insurance 04

SCRANTON — A delivery driver for Federal Express is suing Cigna Group Insurance d/b/a Life Insurance Company of North America (LINA), citing alleged failure to pay his rightful long-term disability benefits.

James P. Shaffer of East Stroudsburg filed a complaint on Feb. 23 in the U.S. District Court for the Middle District of Pennsylvania against Cigna/LINA alleging that the insurance company refused to pay the plaintiff's disability benefits for back ailments.

According to the complaint, the plaintiff alleges that in 2015, he sustained damages from being denied payment for his long-term disability benefits, even though he received short-term disability payments for six months and claims he should have been eligible after that period. Shaffer holds the insurer responsible because of its alleged refusal to pay his long-term policy.

The plaintiff seeks for the court to order that he is entitled to continued long-term disability benefits, seeking all overdue long-term disability benefits, interest, court costs and any further relief the court grants. He is represented by Ronald J. Mishkin of Newman, Williams, Mishkin, Corveleyn, Wolfe & Fareri P.C. in Stroudsburg.
