Metal workers union accuses Steris of terminating employee benefits over lawful strike

PHILADELPHIA — A metal workers labor group is suing Steris Corporation, Steris Corporation Welfare Benefit Plan and Controlled Environment Certification Services Inc. d/b/a Micro Clean, citing alleged breach of contract after the employer terminated 28 employees' group health benefits due to a strike.

Sheet Metal Workers' Local 19 and Jason and Kelli-Anne Frey filed a complaint on Feb. 27 in the U.S. District Court for the Eastern District of Pennsylvania alleging the defendants terminated health benefits of their employees in violation of the Employee Retirement Income Security Act and their own benefits policy.

The plaintiffs claim they sustained damages on behalf of all employees who had their benefits terminated, alleging retaliation by the company after what they say was a lawful strike. The defendants also allegedly failed to send COBRA notices to employees prior to the termination of their benefits.

The plaintiffs seek to enjoin the defendant from terminating their employees' benefits, court costs and any further relief the court grants. They are represented by Benjamin Eisner, Martin W. Milz and Syretta J. Martin of Spear Wilderman PC in Philadelphia.
