Woman says Club Risque misclassified her as a contractor

PHILADELPHIA — A woman has filed a class action lawsuit against her former employer, citing alleged unpaid wages, violation of applicable minimum wage law and violation of Workers' Compensation acts.

Julieann Colon filed a complaint on behalf of all others similarly situated on March 2 in the U.S. District Court for the Eastern District of Pennsylvania against Conchetta Inc., d/b/a Club Risque; RT, 413 Inc., d/b/a Club Risque; Tacony 2008 Inc., d/b/a Club Risque; Connie Innezzelli; Dean M. Pagano; Ronald Crudele; Theodore Pagano Jr.; and Doe Defendants 1-10 alleging that they failed to provide proper compensation to the plaintiff for her work.

According to the complaint, the plaintiff alleges that she sustained damages from performing her work without being paid equal compensation. The plaintiff holds the defendants responsible because they allegedly classified her as independent contractor in order to avoid paying her minimum wage and overtime for hours worked over 40.

The plaintiff requests a trial by jury and seeks injunction against the defendants, unpaid minimum wages, unpaid overtime wages, restitution, liquidated damages, court costs and any further relief this court grants. She is represented by Gerald D. Wells III and Robert J. Gray of Connolly Wells & Gray LLP in King of Prussia.
