BOA made unlawful automated calls in attempt to collect debt, woman says

PHILADELPHIA — A Bucks County woman is suing Bank of America N.A., successor by merger to FIA Card Services N.A., citing alleged violation of telephone harassment statutes.

Donna Bowen filed a complaint on March 3 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the financial institution made automated calls to the plaintiff's cellular telephone over a four-year period to collect a credit card debt.

According to the complaint, Bowen alleges that she sustained damages from being called repeatedly by the defendant on her cell phone. The plaintiff holds the defendant responsible because it allegedly called the plaintiff without prior consent.

The plaintiff requests a trial by jury and seeks $1,500 for each call made in willful violation of the Telephone Consumer Protection Act and $500 for each call made, seeks to enjoin the defendant and seeks any further relief the court grants. She is represented by Joseph M. Adams of the Law Office of Joseph M. Adams in Chalfont.
