PHILADELPHIA — A songwriter is suing Nuclear Blast America Inc., a music label, citing alleged copyright infringement because one of its bands used elements of a song without permission.
Joseph W. Marvin filed a complaint on March 9 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the California label released a song by the band Blind Guardian that used plaintiff's musical composition without a license from the plaintiff.
According to the complaint, the plaintiff alleges that he suffered damages from having his musical composition used without his permission. The plaintiff holds Nuclear Blast America responsible because it allegedly copied copyrighted elements of plaintiff's song.
The plaintiff requests a trial by jury and seeks actual damages in excess of $75,000, punitive damages, court costs and any further relief the court grants. He is represented by Simon Rosen of the Law Office of Simon Rosen in Philadelphia.
