New Jersey Transit Rail allegedly retaliated against employee who blew whistle on practices

PHILADELPHIA — A Tullytown man is suing New Jersey Transit Rail Operations Inc., a railroad carrier, citing alleged insufficient measures were taken to prevent injuries, liability, negligence and retaliation against him for filing a complaint.

Jermaine Jenkins filed a complaint on March 15 in the U.S. District Court for the Eastern District of Pennsylvania alleging that his employer retaliated against him for filing a complaint.

According to the complaint, Jenkins alleges that he was retaliated against and unduly disciplined because he complained about certain alleged activities he and other employees were required to perform which violated the Federal Railroad Administration and company policies. The plaintiff holds the defendant responsible because it allegedly retaliated against him because he brought these violations to light and communicated with his union about them.

The plaintiff requests a trial by jury and seeks compensatory damages, statutory damages, punitive damages, special damages and court costs. He is represented by Robert E. Myers and Lawrence A. Katz of Coffey Kaye Myers & Olley in Bala Cynwyd.
