Bay View collection agency, of Florida, violated FDCPA, Warminster couple says

PHILADELPHIA — A Warminster couple are suing Bay View Loan Servicing LLC, a collection agency, citing alleged misrepresentation in debt collection.

William Schmidt and Shannon Schmidt filed a complaint on March 20 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the Florida-based debt collection agency wrongfully contacted the plaintiffs regarding what it claimed was a mortgage debt.

According to the complaint, the plaintiffs allege that, in April 2015, they sustained damages including frustration, embarrassment and humiliation from having a motion filed against them. The plaintiffs hold Bay View responsible because it allegedly contacted the plaintiff regarding their mortgage in violation of the Fair Debt Collection Practices Act.

The plaintiffs request a trial by jury and seek actual damages, statutory damages, punitive damages, treble damages, court costs and any further relief the court grants. They are represented by Richard H. Kim, Kevin J. Kotch and Drucilla Tigner of The Kim Law Firm LLC in Philadelphia.
