PITTSBURGH — A Brazilian corporation is suing MFC Resources Inc., citing alleged breach of contract and breach of warranty.
Avanex Industria e Commercio Ltda filed a complaint on March 15 in the U.S. District Court for the Western District of Pennsylvania alleging that the defendant failed to deliver the correct goods to the plaintiff.
According to the complaint, Avanex alleges that it sustained financial damages to its business. The plaintiff holds MFC responsible because it allegedly failed to deliver 208 tons of caustic soda at the agreed-upon concentration of 99 percent caustic soda, instead delivering a far weaker solution that is useless to the plaintiff.
The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount that exceeds $75,000 plus interest, damages and punitive damages. They are represented by Anthony S. Posa of The Posa Law Group P.L.L.C. in Pittsburgh.
