Contractor claims Valley Forge Sewer Authority made incomplete payments for upgrades

PHILADELPHIA — A New Jersey contractor is suing Valley Forge Sewer Authority, citing alleged breach of contract for failing to fully compensate the company for its work.

PACT TWO LLC filed a complaint on March 31 in the U.S. District Court for the Eastern District of Pennsylvania against Valley Forge Sewer Authority alleging that it failed to fully compensate the plaintiff.

According to the complaint, the plaintiff alleges that it sustained financial damages from not being fully compensated for its work upgrading sewage facilities for the defendant. The plaintiff holds Valley Forge Sewer Authority responsible because it allegedly breached its contractual obligation to the plaintiff by failing to pay for lost productivity and costs as the result of design errors from the engineering firm it used and existing problems with the facilities.

The plaintiff seeks judgment against the defendant in an amount that exceeds $75,000 plus interest, court costs and any further relief the court grants. The plaintiff is represented by Kevin J. McKeon of Watt, Tieder, Hoffar & Fitzgerald LLP in McLean, Virginia.
