Labor Department claims Exeter Family Restaurant failed to pay adequate wages

PHILADELPHIA — The U.S. Department of Labor has brought suit against Exeter Family Restaurant and Michael J. Nanouh, citing alleged unpaid wages and violation of Workers' Compensation acts.

Edward C. Hugler, acting Secretary of Labor, filed a complaint on March 31 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the defendants, of Reading, failed to provide proper compensation to their employees.

The Labor Department alleges that the defendant restaurant's employees, including certain servers and chefs, were not properly compensated for frequently working in excess of 40 hours per week. The Department holds the defendants responsible because they allegedly failed to pay minimum wage to their employees or pay adequate overtime.

The plaintiff seeks to enjoin the defendant, as well as payment of unpaid minimum and overtime wages, liquidated damages, court costs and interest. The Department is represented by John A. Nocito of the Office of the Solicitor, Region III, in Philadelphia.
