B. Braun Medical sued over allegedly infringing pharmaceutical patent

PHILADELPHIA - A company is suing B. Braun Medical Inc., a Pennsylvania drug company, citing alleged patent infringement in marketing a pharmaceutical product.

Mallinckrodt IP, Mallinckrodt Hospital Products Inc. and SCR Pharmatop filed a complaint on April 4 in the U.S. District Court for the Eastern District of Pennsylvania, alleging the defendant marketed a similar acetaminophen drug delivery system, which infringes the plaintiffs' patents.

According to the complaint, the plaintiffs allege they sustained damages to their business. The plaintiffs hold B. Braun Medical responsible because it allegedly infringed their patent by selling a generic product that not only infringed the patent but also induced others into contributing to the infringement.

The plaintiffs seek injunction against the defendant, monetary relief, court costs and any further relief this court grants.
