Online marketing company says ActiveProspect mischaracterized its business in blog

PHILADELPHIA — An online commerce company based in Ambler is suing ActiveProspect Inc., citing alleged unfair competition concerning a blog post that the company's CEO posted on its website.

Lead Intelligence Inc. d/b/a Jornaya filed a complaint on April 4 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the defendant made false and deceptive statements about the plaintiff in the blog post.

According to the complaint, the plaintiff alleges that it sustained damages to its business. The plaintiff holds ActiveProspect responsible because it allegedly hosted a blog post that contains false information regarding the plaintiff and the nature of its products and services in order to gain a competitive advantage.

The plaintiff requests a trial by jury and seeks to order the defendant to issue a corrective notice on its website and deliver up for destruction all infringing materials, as well as damages, exemplary and punitive damages, court costs and any further relief this court grants. They are represented by David Landau and Richard Heaslip of Duane Morris LLP in Philadelphia.
