PHILADELPHIA - A man is suing Elite Chimney Solutions Inc., CEO Denise L. Rivera and dozens of unnamed individuals with the company, citing alleged violation of telephone harassment statutes.
Andrew R. Perrong filed a complaint on April 3 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging they made several unsolicited calls to the plaintiff's home phone line soliciting sales.
According to the complaint, the plaintiff alleges that in March 2017 he sustained damages from receiving several calls from an automated system. The plaintiff holds the defendants responsible because they allegedly used an automatic telephone dialing system without any consent from the plaintiff.
The plaintiff requests a trial by jury and seeks $500 for each negligent violation, $1,500 for each knowing violation, injunctive relief, compensatory, general, incidental and consequential damages, punitive and special damages, interest, court costs and any further relief the court grants. He is representing himself in the case.
