Painters' union says Atsalis Brothers failed to make required contributions

PHILADELPHIA — A local painters' union is suing Atsalis Brothers Painting Co., citing alleged breach of contract.

The International Union of Painters and Allied Trades District Council No. 21 and its associated employee benefits funds, and Joseph Ashdale, its trustee, filed a complaint on April 12 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that they failed to make contributions to the funds as required by contract.

According to the complaint, the plaintiffs allege that they sustained damages due to the unpaid contributions. The plaintiffs hold Atsalis Brothers responsible because the defendant allegedly failed to remit funds for its employees' benefits based on the bargaining agreement in place.

The plaintiffs seek the amount of $13,071.70, interest at the rate of 5 percent, liquidated damages, court costs and any further relief this court grants. They are represented by Syretta J. Martin of Spear Wilderman P.C. in Philadelphia.
