Retiree claims union failed to keep record of employment, denied pension

PHILADELPHIA — A retiree from the newspaper industry is suing Teamsters Local Union No. 1414, Newspaper and Magazine Employees Union, citing alleged breach of contract for denying his pension.

Michael W. McCarrin filed a complaint on April 13 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, including their relevant benefits funds and trustees, alleging that they denied plaintiff's application for retirement benefits. Mario Pollera, William Di Florio, Timothy Feeney and Joseph Lyons were individuals named in the suit.

According to the complaint, the plaintiff alleges that he sustained damages from having his pension benefits denied. The plaintiff holds the defendants responsible because it allegedly denied plaintiff's application based on the fact that it could not find a record of plaintiff's employment before a certain date in order to qualify for the pension. Plaintiff asserts he was employed by the Philadelphia Inquirer before that date.

The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of $520,968 plus court costs and any further relief this court grants.
