PHILADELPHIA — A West Chester business is suing Therapy Source Inc., citing alleged unfair competition.
EBS Healthcare Inc. filed a complaint on April 13 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the Plymouth Meeting-based company used plaintiff's mark to advertise its business.
According to the complaint, the plaintiff alleges that it sustained damages to its business and reputation because of the defendant's actions. The plaintiff holds Therapy Source responsible because the defendant allegedly purchased web addresses using the plaintiff's "EBS HEALTHCARE" mark and redirected visitors from those sites to its own website.
The plaintiff requests a trial by jury and seeks to enjoin the defendant and for the defendant to deliver for destruction all devices, literature, advertising and other infringing materials, as well as damages, enhanced damages, actual damages, exemplary damages, court costs and any further relief this court grants.
