PITTSBURGH — A union is suing East Coast Paving & Sealcoating Inc., citing alleged breach of contract.
Operating Engineers Local 66 and Construction Industry Combined Funds Inc., as agent for the Board of Trustees of the organization and its relevant funds, filed a complaint on April 20 in the U.S. District Court for the Western District of Pennsylvania alleging that the contractor, based in New Castle, failed to remit its employees' contributions to the labor group's funds.
According to the complaint, the plaintiffs allege that they were damaged due to unpaid employee benefits. The plaintiffs hold East Coast Paving & Sealcoating responsible because the defendant allegedly failed to make payments to the plaintiff as required by the collective bargaining agreement.
The plaintiffs seek judgment against the defendant in the amount of $36,623.97, plus attorneys' fees of $7,324.79, interest at 1 percent per month, court costs, payment in full of any additional amounts and any further relief this court grants. They are represented by Jeffrey J. Leech and Neil J. Gregorio of Tucker Arensberg P.C. in Pittsburgh.
