Photographer says McGraw-Hill used photos outside of licensing agreement

PHILADELPHIA — A photographer is suing McGraw-Hill Global Education Holdings LLC and McGraw-Hill School Education Holdings LLC, citing alleged copyright infringement.

Ed Kashi filed a complaint on April 21 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that they printed several of plaintiff's photographs significantly more times than what was authorized by the plaintiff.

According to the complaint, the plaintiff alleges that he was damaged from having his photographs used outside of the license agreement. The plaintiff holds McGraw-Hill responsible because it allegedly published plaintiff's photographs outside the authorized distribution area and used them in foreign publications, which violated their agreement. Since 1995, Kashi had licensed his photos to stock photo companies, who then entered into agreements with McGraw-Hill with restrictions on use, which the defendant violated.

The plaintiff requests a trial by jury and seeks injunction against the defendant, impoundment of all copies of plaintiff's photographs, actual damages, profits, court costs and any further relief this court grants. He is represented by Maurice Harmon, Amanda L. Bruss and Christopher Seidman of Harmon Seidman Bruss & Kerr LLC in New Hope and in Colorado.
