PHILADELPHIA — A pharmacy is suing Shree Navdurga LLC d/b/a Ramsrx Pharmacy and Ramesh Kommineni, citing alleged unfair competition for adopting a similar trade name and failing to change it.
Rann Pharmacy Inc. filed a complaint on April 25 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that the business name that the Lansdale pharmacy has been using is too close to the plaintiff's service mark.
According to the complaint, the plaintiff alleges that it was damaged from the defendants' use of a similar mark. The plaintiff holds the defendants responsible because they allegedly used the name Rams Pharmacy, and though the defendant Kommineni claimed he was in the process of changing over all marks to the Ramsrx title, he has continued to use the infringing mark.
The plaintiff seeks to enjoin the defendant's use of the "Rams" mark and order the defendant to retract and impound all infringing labels, signs, prints and advertisements bearing plaintiff's mark, and seeks any further relief this court grants.
