PHILADELPHIA — An eye-care products maker is suing Lunovus LLC, based in Alabama, and various individuals with the company alleging patent infringement.
Physicians Recommended Nutriceuticals LLC, based in Plymouth Meeting, filed a complaint on April 27 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that they infringed plaintiff's patent for a tear-support product.
According to the complaint, the plaintiff alleges that it was damaged from having its patented invention infringed. The plaintiff holds Lunovus responsible because it allegedly made a product that includes the identical formulation of the tear-support product claimed in a patent registered to the plaintiff.
The plaintiff requests a trial by jury and seeks compensatory damages not less than $150,000, treble damages, interest, court costs, permanent injunction, actual damages, enhanced profits and any further relief this court grants.
