Walsh Construction says Pennsylvania subcontractor owes money stemming from PennDOT project

PHILADELPHIA — A Chicago contractor is suing W.G. Tomko Inc., of Finleyville, citing alleged breach of contract.

Walsh Construction Company II LLC filed a complaint on May 5 in the U.S. District Court for the Eastern District of Pennsylvania against W.G. Tomko, who was Walsh's subcontractor, alleging that it failed to pay the plaintiff for work it performed to assist Tomko on a Pennsylvania Department of Transportation project.

According to the complaint, the plaintiff alleges that it sustained financial damages from not being paid. The plaintiff holds the defendant responsible because of the amounts due and because the subcontractor allegedly threatened the plaintiff with legal action.

The plaintiff seeks to declare that the plaintiff did not breach the subcontract and the plaintiff is not liable to the defendant, as well as court costs. It is represented by Richard H. Lowe of Duane Morris LLP in Philadelphia.
