Class action filed against Navient claiming student loan debt servicer committed fraud

SCRANTON — An individual has filed a class action lawsuit against Navient Corporation, Navient Solutions Inc. and Navient Solutions LLC, citing alleged breach of contract and fraud for its handling of student loan debt.

Olga Demyanenko-Todd filed a complaint on behalf of all others similarly situated on May 1 in the U.S. District Court for the Middle District of Pennsylvania against the defendants alleging that they failed to provide timely notice to the plaintiff regarding their deadlines for renewing their income driven repayment (IDR) plans for student loans.

According to the complaint, the plaintiff alleges that she was damaged from having interest wrongly added to the principal balance of her loan. The plaintiff holds the defendants responsible because they allegedly failed to inform the plaintiff and the class regarding their deadlines to recertify their enrollment in IDR plans.

The plaintiff requests a trial by jury and seeks injunction against the defendant, compensatory and punitive damages, interest, court costs and any further relief this court grants. She is represented by Robert D. Schaub of Rosenn Jenkins & Grennwald LLP in Wilkes-Barre.
