Recycling company says former president used proprietary data to start competitor

ERIE — A Cochranton company is suing Buck Baldwin and Envirothink Inc., a former employee and the company he founded, citing alleged breach of duty.

Environmental Coordination Services & Recycling Inc. filed a complaint on April 27 in the U.S. District Court for the Western District of Pennsylvania against the defendants alleging that Baldwin misappropriated plaintiff's trade secrets for his own benefit.

According to the complaint, the plaintiff alleges that it sustained damages from having its confidential information taken from it. The plaintiff claims that Baldwin, while still acting as president of the plaintiff company, was developing the defendant business using trade information he accessed through the plaintiff. The plaintiff holds Baldwin and Envirothink responsible because they allegedly took proprietary information from it.

The plaintiff requests a trial by jury and seeks compensatory damages, disgorgement of all profits, court costs, punitive and exemplary damages, monetary damages, injunction and any further relief this court grants. They are represented by Matthew W. McCullough and Mark T. Pavkov of MacDonald, Illig, Jones & Britton LLP in Erie.
