Woman says Mercer Primary Care doctor punctured eardrum

PITTSBURGH — An individual is suing the United States of America, Primary Health Network, Timothy Fullerton D.O. d/b/a Mercer Primary Care and Diana Keisel LPN, citing alleged insufficient measures were taken to prevent injuries, liability and negligence.

Sandra Brei filed a complaint on May 11 in the U.S. District Court for the Western District of Pennsylvania against the defendants alleging that they failed to provide proper medical care to the plaintiff.

According to the complaint, the plaintiff alleges that she sustained hearing loss due to a procedure done to her ear at Mercer Primary Care, which is operated by the U.S. Department of Health and Human Services. The plaintiff holds the defendants responsible because the doctor at the facility allegedly caused a hole in plaintiff's eardrum during an attempt to remove the build-up of earwax.

The plaintiff seeks judgment against the defendant in an amount that exceeds the jurisdictional limits of this court plus court costs and interest. She is represented by Dominic D. Salvatori of Philadelphia.
