Maintenance worker says Berger Real Estate Investment failed to pay overtime

PHILADELPHIA — An employee is suing Berger Real Estate Investment Inc. and its owner Arnold Berger, citing alleged unpaid wages, violation of applicable minimum wage law and violation of Workers' Compensation acts.

Sakinak Irby filed a complaint on May 8 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging that they failed to pay proper compensation to the plaintiff for her maintenance work at one of their apartment complexes in Philadelphia.

According to the complaint, the plaintiff alleges that she was damaged from performing her duties at work at the Overbrook Gardens complex without being properly compensated. The plaintiff holds Berger Real Estate Investment and Arnold Berger responsible because the company and owner allegedly failed to pay adequate overtime and minimum wage to the plaintiff despite her regularly working over 40 hours per week.

The plaintiff requests a trial by jury and seeks all wages, statutory damages, court costs, interest and any further relief this court grants. She is represented by Andrew S. Abramson of Abramson Employment Law LLC in Blue Bell.
