Business owners sue Norristown, town council for refusal to fix drainage system

PHILADELPHIA — Two individuals are suing the Municipality of Norristown and Norristown Municipal Council, alleging violation of civil rights and violation of federal law for refusing to repair a public drainage system under their business.

Ludovico Cognata and Alberto Cognata filed a complaint on May 15 in the U.S. District Court for the Eastern District of Pennsylvania alleging that the defendants refused to repair a culvert under the plaintiffs' property, which houses an auto body shop.

According to the complaint, the plaintiffs allege that they were harmed from having their property damaged. The plaintiffs hold the defendants responsible because they allegedly caused damages to the plaintiffs' property by refusing to fix the culvert despite the plaintiffs' demands.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount that exceeds $150,000, punitive damages, interest, court costs and any further relief this court grants. They are represented by Charles D. Mandracchia and Jeffrey W. Soderberg of Mandracchia Law LLC in Skippack.
