R & B Contracting & Excavating accused of skipping union payments

PHILADELPHIA — A labor group is suing R & B Contracting & Excavating Inc. a/k/a R & B Contracting & Excavation Inc., alleging breach of contract for failing to pay into union funds.

Martin O'Toole and Regis Claus, trustees on behalf of Plumbers Local Union No. 27 combined funds, filed a complaint on May 15 in the U.S. District Court for the Western District of Pennsylvania alleging that the contractor, based in West Mifflin, failed to remit its monthly contributions to the union.

According to the complaint, the plaintiffs allege that they were damaged due to the unpaid contributions. The plaintiffs hold the defendant responsible because it allegedly breached the collective bargaining agreement with the plaintiff by failing to remit its employees' contributions to the funds.

The plaintiffs seek injunction against the defendant, immediate payment, an audit of defendant, money judgment of $33,835.09, liquidated damages, attorneys' fees of 20 percent, court costs and any further relief this court grants. They are represented by Jeffrey J. Leech and Neil J. Gregorio of Tucker Arensberg P.C. in Pittsburgh.
