Delivery drivers say State College wings restaurant failed to pay adequate wages

SCRANTON — Five former delivery drivers have filed a class-action lawsuit against Wings Over Happy Valley MDF LLC d/b/a WIngs Over Happy Valley and Steven C. Moreira, alleging unpaid wages, violation of applicable minimum wage law and violation of Workers' Compensation acts.

Jacob Wilson, Ty Carts, Lewis Grove, Colin Krieger and Branden Ronald filed a complaint on behalf of all other similarly situated individuals on May 24 in U.S. District Court for the Middle District of Pennsylvania against the defendants alleging that the State College take-out restaurant failed to pay fair compensation to the plaintiffs.

According to the complaint, the plaintiffs allege that they were damaged from not being paid properly for their work. The plaintiffs hold Wings Over Happy Valley and Moreira responsible because the defendants allegedly failed to pay minimum wage to the plaintiffs.

The plaintiffs request a trial by jury and seek back pay, liquidated damages, interest, monetary penalties, court costs and any further relief this court grants. They are represented by David B. Consiglio and David S. Gaines Jr. of Miller, Kistler & Campbell in State College.
