Coraopolis woman sues Liberty Life Assurance for denying her long-term disability claim

Insurance 09

ERIE — An employee of Highmark Inc. is suing Liberty Life Assurance Company of Boston, alleging breach of contract for wrongful termination of disability benefits.

Rita J. Hemmings of Coraopolis filed a complaint on May 30 in U.S. District Court for the Western District of Pennsylvania alleging that the insurance company refused to pay plaintiff's long-term disability benefits.

According to the complaint, the plaintiff alleges that she was damaged from having her long-term disability benefits denied after receiving short-term disability benefits. The plaintiff holds Liberty Life Assurance Company of Boston responsible because the defendant allegedly denied plaintiff's claims for benefits despite sufficient evidence of plaintiff's disabilities.

The plaintiff seeks judgment against the defendant in an amount that exceeds the jurisdictional limits of this court, court costs, interest and any further relief this court grants. She is represented by Max Petrunya of Robert Peirce & Associates P.C. in Pittsburgh.
