Blair Vineyards, of California, sues Pennsylvania winery of same name

PHILADELPHIA — A California winery is suing Blair Vineyards LLC, a Pennsylvania company with the same corporate name, alleging trademark infringement.

Blair Vineyards LLC of California filed a complaint on June 1 in U.S. District Court for the Eastern District of Pennsylvania against Blair Vineyards LLC of Kutztown, alleging that the wine seller is in violation of trademark laws.

According to the complaint, the plaintiff alleges that it was damaged from the defendant's confusing use of the same name and the "Blair" mark in which it sells wine. The plaintiff holds the defendant company responsible because it allegedly continued to use the "Blair" mark to advertise its products despite the plaintiff's request that they stop using the mark. The plaintiff markets wines under the "Blair" and "Blair Estates" labels.

The plaintiff requests a trial by jury and seeks injunction against the defendant, the recall of all infringing products, all damages, all profits, punitive damages, court costs and any further relief this court grants. It is represented by Manny D. Pokotilow of Caesar Rivise PC in Philadelphia.
