Former Penn State employee alleges interference with FMLA

SCRANTON — An employee is suing Penn State University, alleging violation of the Family and Medical Leave Act (FMLA).

Tiffany Shultz filed a complaint on June 14 in U.S. District Court for the Middle District of Pennsylvania against Penn State alleging that her employer interfered with her FMLA rights.

According to the complaint, the plaintiff alleges that she was damaged from being placed on an indefinite unpaid leave. The plaintiff holds Penn State responsible because the defendant allegedly approved plaintiff's FMLA leave without informing her that she was placed on an unpaid administrative leave, contrary to plaintiff's understanding. Plaintiff was terminated in June 2015.

The plaintiff requests a trial by jury and seeks judgment against the defendant, front pay, back pay, compensatory damages, interest, court costs and any further relief this court grants. She is represented by Amy H. Marshall of Babst, Calland, Clements and Zomnir P.C. in State College.
