Consumer alleges Comenity Bank invaded privacy with calls to cellphone

SCRANTON – An Olyphant woman alleges a financial institution intruded on her seclusion with numerous calls to her cellphone.

Renee Barnauskas filed a complaint on June 26 in the U.S. District Court for the Middle District of Pennsylvania against Comenity Bank alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that she revoked her consent for the defendant to contact her using an automatic dialing system but that the defendant continues to call her. The plaintiff holds Comenity Bank responsible because the defendant allegedly invaded her privacy with the calls.

The plaintiff requests a trial by jury and seeks statutory damages between $500 and $1,500, court costs and any further relief the court grants. She is represented by Brett Freeman of Sabatini Law Firm LLC in Dunmore.
