PHILADELPHIA – A West Chester general merchandise electronic retailer alleges items it ordered from a California company were defective.
QVC Inc. filed a complaint on June 30 in the U.S. District Court for the Eastern District of Pennsylvania against Global Plastic Supply Inc. seeking declaratory judgment.
According to the complaint, the plaintiff ordered film and packaging materials from the defendant in December 2015 for use with packaging and shipping apparel to the plaintiff's customers. The suit states the defendant submitted invoices of $89,065.92 for the items.
The plaintiff alleges that the perforations on the items were defective and nonconforming and rejected the items and refused to pay the same.
The plaintiff seeks judgment that the items were defective and rightfully and lawfully rejected in accordance with its rights. It is represented by Amy S. Kline of Saul Ewing LLP in Philadelphia.
