Former technician says Eaton Corp. didn't pay overtime wages, was fired in retaliation

ERIE – An Ohio man alleges that a Moon Township employer terminated him in relation over overtime pay.

James Smeltzer filed a complaint on June 26 in the U.S. District Court for the Western District of Pennsylvania against Eaton Corp. alleging violation of the Fair Labor Standards Act and the Pennsylvania Wage Payment and Collection Law.

According to the complaint, the plaintiff alleges that he hired by the defendant in April 2005 as a lead engineering technician. The suit states that he was terminated in June 2015 for what the defendant called a violation of its code of ethics, alleging that the plaintiff falsified documents to receive overtime pay.

The plaintiff holds Eaton Corp. responsible because the defendant allegedly assigned the plaintiff work it knew would take longer than 40 hours per week to complete and terminated plaintiff's employment in retaliation for submitting of his actual time worked.

The plaintiff requests a trial by jury and seeks judgment against the defendant for overtime compensation, liquidated damages, court costs and any further relief this court grants. He is represented by Sean A. Casey of Sean A. Casey, Attorney at Law PC in Pittsburgh.
