SCRANTON – A York woman alleges that she was not notified of her health care benefits in a timely manner after her termination.
Robin Eyster filed a complaint on July 3 in the U.S. District Court for the Middle District of Pennsylvania against Surgical Anesthesia Services LLC and Joe McDonnell alleging violation of the Employee Retirement Income Security Act and the Consolidated Omnibus Budget Reconciliation Act.
According to the complaint, the plaintiff was employed by Surgical Anesthesia Services until her termination in January. The plaintiff holds Surgical Anesthesia Services LLC and McDonnell responsible because the defendants allegedly failed to send the COBRA documentation to the plaintiff upon her termination. She alleges that she incurred undue expenses because of the delay in notification.
The plaintiff seeks judgment against the defendant for penalties, medical bills incurred, expenses, court costs, interest and any further relief the court grants. She is represented by Jeremy A. Donham of Donham Law in Dellslow, West Virginia.
