ERIE – A Pittsburgh company alleges its copyrighted mark is unlawfully being used by another company.
FI360 Inc. filed a complaint on July 13 in the U.S. District Court for the Western District of Pennsylvania against Ycharts Inc. alleging trademark and copyright infringement.
According to the complaint, the plaintiff markets and sells informational services to investment advisers under the marks FI360 Fiduciary Score and Fiduciary Score.
The plaintiff holds Ycharts Inc. responsible because the defendant's use of the mark The Fiduciary Score is allegedly likely to cause confusion or to deceive the affiliation of the defendant with the plaintiff.
The plaintiff seeks to enjoin the defendant, damages, treble damages, court costs and any further relief the court grants. It is represented by John C. Thomas III, Charles H. Dougherty Jr. and Richard T. Ting of Beck & Thomas PC in Pittsburgh.
