Acosta Inc. alleges former director left for competitor, unlawfully used confidential information

PHILADELPHIA – A Florida outsourced sales and marketing agency alleges that a Schnecksville man misappropriated confidential information.

Acosta Inc. filed a complaint on July 24 in the U.S. District Court for the Eastern District of Pennsylvania against Joseph Navitsky and Johnson O'Hare Co. Inc. alleging breach of contract and tortious interference with an existing business and contractual relationship.

According to the complaint, Navitsky was employed by the plaintiff as the director of fresh foods for the Northeast region from January 2015 until his resignation in June, when he left to work for Johnson O'Hare Co. The suit states Johnson O'Hare Co. is a competitor of the defendant.

The plaintiff holds Navitsky and Johnson O'Hare Co. Inc. responsible because Navitsky allegedly misappropriated the plaintiff's confidential information to benefit himself and Johnson O'Hare Co. at the plaintiff's expense.

The plaintiff requests a trial by jury and seeks injunctive relief, actual damages, interest and any further relief this court grants. It is represented by Karla L. Johnson of McGuire Woods LLP in Pittsburgh.
