Woman seeks disability benefits she alleges are due to her from Life Insurance Co. of North America

ERIE – A Washington County woman alleges that her long-term disability benefits were wrongfully terminated.

Julieanne Balach filed a complaint on July 27 in the U.S. District Court for the Western District of Pennsylvania against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff suffered a concussion as a result of a vehicle accident in 2013 and the defendant approved her long-term disability benefits in June 2014. The suit states her benefits were terminated in June 2016 on its reasoning that she was no longer disabled.

The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly failed to provide a full and fair review.

The plaintiff seeks benefits due to her, enjoin the defendant, restitution or disgorgement, court costs, and any further relief the court grants. She is represented by Tybe A. Brett and Ruairi McDonnell of Feinstein Doyle Payne & Kravec LLC in Pittsburgh.
