AmerisourceBergen Drug Corp. seeks more than $3 million it claims it is owed

PHILADELPHIA – A Conshohocken pharmaceutical distributor alleges that it is owed millions from a Texas-based pharmacy.

AmerisourceBergen Drug Corp. filed a complaint on Aug. 2 in the U.S. District Court for the Eastern District of Pennsylvania against A & E Community Pharmacy Inc., doing business as Heights Community Pharmacy, and Alex Enoch Brumfield alleging breach of contract and other counts.

According to the complaint, A & E Community Pharmacy Inc. entered a credit application and credit agreement in June 2014 with the plaintiff with Brumfield as guarantor.

The plaintiff holds A & E Community Pharmacy Inc. and Brumfield responsible because the defendants allegedly breached their contractual agreement by failing to indemnify and reimburse the plaintiff for roughly $3.8 million it had to pay to a third-party payer on the defendant pharmacy's behalf.

The plaintiff seeks judgment against the defendant in the amount of $3,044,940.49 plus interest, court costs and any further relief the court grants. It is represented by Joseph J. McHale, Mark J. Dorval and Samantha B. Kats of Stradley Ronon Stevens & Young LLP in Philadelphia.
