Disabled man seeks disability payments form Life Insurance Co. of North America

ERIE – A Butler County resident alleges that his disability benefits were wrongfully terminated.

Kenneth Jones filed a complaint on Aug. 2 in the U.S. District Court for the Western District of Pennsylvania against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges worked as a registered nurse until he was disabled due to chronic pain caused by his post-laminectomy syndrome in May 2013. The suit states he applied for benefits and was approved in August 2013, but the defendant terminated his benefits in July 2014. Benefits were later resumed and then terminated again in August 2015, the suit states.

The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly failed to provide a full and fair review.

The plaintiff seeks pay all benefits due to the plaintiff plus interest, enjoin the defendant, restitution, court costs and any further relief the court grants. He is represented by Tybe A. Brett of Feinstein Doyle Payne & Kravec LLC in Pittsburgh.
