Walter Studley Real Estate Sales Corp. alleged to have used deceptive means in eviction complaint

PHILADELPHIA – A Holland woman claims a Warrington debt collector made false representations in its attempt to evict her.

Diane M. Zimmerman filed a complaint on Aug. 11 in the U.S. District Court for the Eastern District of Pennsylvania against Walter Studley Real Estate Sales Corp. and Walter Studley citing the Fair Debt Collection Practices Act and other counts.

According to the complaint, the defendants were hired by ZMMHH LLP to recover real property from the plaintiff. She alleges that in August 2016, the defendants falsely represented that they had purchased the property and that she needed to vacate immediately. She alleges the defendants failed to identify themselves as debt collectors and also filed a landlord/tenant complaint that falsely stated that they were the landlords.

The plaintiff holds Walter Studley Real Estate Sales Corp. and Studley responsible because the defendants allegedly used deceptive means and false representations regarding her debt in order to evict the plaintiff from her home.

The plaintiff seeks compensatory damages not in excess of $150,000, compensatory damages, exemplary damages that does not exceed $150,000, court costs, interest and any further relief this court grants. She is represented by Alan B. Kane of The Law Office of Alan B. Kane in Warminster.
