Delaware County 911 dispatcher alleges county refused to reinstate her after leave for treatment program

PHILADELPHIA – An Essington woman alleges she was not reinstated to her job after taking a leave for a drug treatment program.

Anne Rickards filed a complaint on Aug. 8 in the U.S. District Court for the Eastern District of Pennsylvania against Delaware County and Delaware County Emergency Services and John Doe Defendants Nos. 1-10 citing the Family and Medical Leave Act.

According to the complaint, the plaintiff was employed by the defendants as a 911 dispatcher. The suit states she had been prescribed oxycodone and Vicodin for back pain and in December 2015, took an approved medical leave to enter an in-patient drug additional treatment. She alleges she has not relapsed and never used drugs during work hours or was under the influence during work hours.

The plaintiff holds Delaware County and Delaware County Emergency Services and John Doe Defendants Nos. 1-10 responsible because the defendants allegedly refused to reinstate her employment after her leave.

The plaintiff requests a trial by jury and seeks compensatory damages of more than $150,000 plus punitive damages, court costs, interest and any further relief the court grants. She is represented by Graham F. Baird of Law Offices of Eric A. Shore PC in Philadelphia.
