Delaware County Memorial Hospital employees allege they should be paid for meal breaks not taken

PHILADELPHIA – Two employees of Delaware County Memorial Hospital allege they were not paid for all hours worked.

Nancy Gauzza and Melissa McCloskey filed a complaint on behalf of all others similarly situated on Aug. 10 in the U.S. District Court for the Eastern District of Pennsylvania against Prospect Medical Holdings Inc. and Delaware County Memorial Hospital citing the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.

According to the complaint, the plaintiffs allege that the defendants automatically deducted 30 minute meal periods from their checks but that they never got to take these breaks.

The plaintiffs holds Prospect Medical Holdings Inc. and Delaware County Memorial Hospital responsible because the defendants allegedly failed to provide uninterrupted meal breaks and failed to pay wages owed for this time.

The plaintiffs request a trial by jury and seek compensatory damages, all unpaid wages, interest, reimburse the plaintiffs, injunction, court costs, and any further relief the court grants. They are represented by David J. Cohen of Stephan Zouras LLP in Philadelphia.
