PHILADELPHIA – A Schuylkill County woman's lawsuit states that her employer "operated a willful scheme to deprive" certain types of its employees overtime compensation.

Ann Wood filed a complaint on behalf of all others similarly situated on Aug. 11 in the U.S. District Court for the Eastern District of Pennsylvania against AmeriHealth Caritas Services LLC alleging violation of the Fair Labor Standards Act and the Pennsylvania Minimum Wage Act.

According to the complaint, the plaintiff has been employed by the defendant since November 2012 as a clinical care reviewer. The plaintiff holds AmeriHealth Caritas Services, LLC responsible because the defendant allegedly failed to pay overtime wages at a rate of time-and-one-half to the plaintiff based on the total number of working hours.

The plaintiff seeks unpaid back wages, all damages, civil penalties, liquidated damages, interest, court costs and any further relief the court grants. She is represented by Patricia Barasch of Schall & Barasch LLC in Moorestown, New Jersey.
