Man alleges Bank of America owes him $65,000

PHILADELPHIA – A Phoenixville man alleges that financial institutions used false and misleading means in an attempt to collect an alleged debt.

John Massaro filed a complaint on Aug. 18 in the U.S. District Court for the Eastern District of Pennsylvania against Bank of America, N.A., Nationstar Mortgage LLC, CSMC Mortgage Loan Trust 2006-3 U.S. Bank Trust National Association alleging violation of the Fair Debt Collection Practices Act and other counts.

According to the complaint, in late 2011, he plaintiff sold development rights to a property he owned for $185,000 and intended to use the money to bring two mortgages current. The suit states $65,000 would be left over from the sale after the two loans were made current, but Bank of America failed to send the money.

The plaintiff requests a trial by jury and seeks actual damages of at least $65,000, court costs and any further relief the court grants. He is represented by Joseph F. Claffy.
