Green Air Mechanical alleged to have failed to pay $326 in contributions; Plaintiffs seek thousands in damages

SCRANTON – A Glen Rock employer is alleged to have failed to pay contributions to labor union groups for a few months in 2016.

Frank Kelly and Todd C. Ray, as trustees of the Plumbers and Pipefitters Local No. 520 Pension Fund, et al. filed a complaint on Aug. 15 in the U.S. District Court for the Middle District of Pennsylvania against Green Air Mechanical LLC alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that they were damaged due to unpaid and late-paid contributions. The plaintiffs hold Green Air Mechanical LLC responsible because the defendant allegedly breached their agreement with the labor group by failing to remit its employees' contributions for March through August 2016.

The plaintiffs seek contributions due in the amount of $326.34; liquidated damages in the amount of $15,437.79; interest; liquidated damages and interest due in the amount of $10,075.38; court costs; filing fees of $400; service fees of $137.50; and any further relief the court grants. They are represented by Charles W. Johnston of Charles W. Johnston PC in Camp Hill.
