Dentsply Sirona Inc. alleges unauthorized vendors sell products on Net32 site

SCRANTON – A York corporation that produces and sells dental products alleges that a North Carolina discount dental supply business is selling products meant for foreign markets on its site.

Dentsply Sirona Inc. filed a complaint on Aug. 25 in the U.S. District Court for the Middle District of Pennsylvania against Net32 Inc. alleging trademark infringement.

According to the complaint, the plaintiff is the owner of the Dentsply marks, which is on all of its dental products.

The plaintiff holds Net32 Inc. responsible because the defendant's online marketplace allows vendors to sell Dentsply products intended for sale only in foreign markets to resell in the U.S. and that none of its vendors are authorized distributors.

The plaintiff requests a trial by jury and seeks enjoin the defendant, order the defendant to remove all listing from the website offering for sale Dentsply products, order the defendant to recall all infringing products, deliver up for destruction all infringing products, actual damages, treble damages, interest, exemplary and punitive damages, court costs and any further relief the court grants.
