Beacon Roofing Supply Inc. files suit against similarly named companies

ERIE – A Virginia roofing supply distributor alleges that two Pittsburgh individuals are using a similar name for their business.

Beacon Roofing Supply Inc. filed a complaint on Aug. 22 in the U.S. District Court for the Western District of Pennsylvania against Ginger Miller and Paul Efferin, individually and doing business as Beacon Roofing and Asphalt and Beacon Roofing Systems alleging trademark infringement, false designation of origin and other counts.

According to the complaint, the plaintiff is the owner of 25 trademarks covering derivations of the name Beacon. It alleges that the defendants began their companies in July and are using its trademarked name and lighthouse logo.

The plaintiff holds Miller and Efferin responsible because the defendants' trade names "risk creating a mistaken association by members of the public with Beacon," the suit states.

The plaintiff seeks enjoin the defendants from further using the plaintiff's trademark, pay damages to the plaintiff, all profits, treble damages, interest, court costs and any further relief this court grants. It is represented by Steven B. Silverman of Babst, Calland, Clements & Zomnir P.C. in Pittsburgh.
