PHILADELPHIA – A man alleges a reckless mailing from an insurer revealed his private health information.
Andrew Beckett, a pseudonym to protect his privacy, filed a complaint on behalf of all others similarly situated on Aug. 28 in the U.S. District Court for the Eastern District of Pennsylvania against Aetna Inc., Aetna Life Insurance Co., Aetna Specialty Pharmacy LLC and Doe Vendor alleging negligence and other counts.
According to the complaint, on July 31, the plaintiff received a notice from the defendants regarding a settlement to his address that contained instructions on how to fill his prescription for HIV medication. He alleges part of the letter's contents was plainly visible through the large window section of the envelope
The plaintiff requests a trial by jury and seeks damages, statutory damages, punitive damages, court costs and any further relief the court grants. He is represented by Shanon J. Carson and Sarah R. Schalman-Bergen of Berger & Montague PC in Philadelphia.
