Cooper-Booth Transportation Co. alleges Freightliner trucks have defects

PHILADELPHIA – A Mountville company alleges that nine trucks it purchased have defects.

Cooper-Booth Transportation Co. LP filed a complaint on Aug. 29 in the U.S. District Court for the Eastern District of Pennsylvania against Daimler Trucks of North America LLC and Detroit Diesel Corp. alleging breach of express warranties, breach of contract and other counts.

According to the complaint, the plaintiff alleges that it purchased nine new 2014 model Freightliner box trucks in 2013 from an authorized dealer of the defendants. It alleges that the trucks have exhibited debilitating powertrain defects and that the defendants have refused to honor any attendant warranties to cover the defects.

The plaintiff holds Daimler Trucks of North America LLC and Detroit Diesel Corp. responsible because the defendants allegedly breached the warranties by failing to correct the defects.

The plaintiff requests a trial by jury and seeks judgment against the defendant, all damages of more than $75,000, interest and court costs. It is represented by Daniel M. Lieberman and Stephen J. Fleury Jr. of Devine Law Offices, LLC in Lancaster.
